Business customers only
This offer is exclusively for entrepreneurs within the meaning of section 14 of the German Civil Code. By ordering, the customer confirms that they are acting in the course of their commercial or self-employed professional activity. Contracts with consumers are not concluded.
1. Provider and scope
The provider is Earl Flanagan, trading as Professional English Services (PES). These terms apply to the First Impression Audit and further services unless otherwise agreed in text form. Individual agreements take precedence.
2. Service
The First Impression Audit is a professional analysis of one English-language sales asset. It includes an assessment of the first impression, observations on clarity, relevance and credibility, specific revision examples and prioritised next steps.
A complete rewrite, technical implementation, publication, legal, tax or business advice, and assessment of additional assets are excluded unless expressly agreed.
3. Ordering
Orders and payment processing are handled through Gumroad. PES may request evidence of business status and decline acceptance if the purchaser is acting as a consumer.
4. Price and payment
The base price is €199. Gumroad may add taxes to the purchase; the final total is displayed at checkout before payment. PES applies section 19 of the German VAT Act and does not separately state VAT on its own invoices. Gumroad may display the euro price in another currency. Payment methods and transaction-related information are governed by the Gumroad terms displayed at checkout.
5. Customer cooperation
The customer supplies the asset in a usable format, identifies the target audience, business objective and relevant circumstances, and confirms the necessary rights to the content.
6. Start and delivery
Work begins once payment and complete working materials have been received. The normal delivery time is five business days. Deadlines are binding only when expressly confirmed.
7. Confidentiality and usage rights
PES treats non-public customer materials as confidential. After full payment, the customer receives a non-exclusive right, without time or territorial limits, to use the results created specifically for them for internal business purposes.
8. Cancellation and refunds
There is no consumer right of withdrawal. Cancellation may be requested in text form before work begins. Refunds take account of services already provided, costs and Gumroad rules.
9. Professional responsibility
The customer is responsible for deciding how to use and publish the results. PES does not guarantee a particular revenue level, market success or contract conclusion.
10. Liability
PES has unlimited liability for intent and gross negligence, injury to life, body or health, and cases of mandatory statutory liability. For a slightly negligent breach of an essential contractual obligation, liability is limited to foreseeable damage typical of the contract.
11. Law and jurisdiction
German law applies. Where legally permitted, the business location of PES is agreed as the place of jurisdiction.
12. Final provision
If a provision is or becomes invalid, statutory provisions apply. The remaining provisions remain effective.
